Terms and Conditions
These Terms and Conditions (“Terms”) constitute a legally binding contract between the user (“User”) and Maud Archive Inc. (“Company”), governing the use of the website maudst.ca (“Website”) and the purchase of any items (“Items”) from the Company.
By accessing the Website and/or purchasing Items, the User acknowledges and agrees to be bound by these Terms.
Final Sale Policy
All transactions made through maudst.ca are final sale, except where an Item is demonstrably inauthentic or damaged upon receipt, as determined exclusively by Maud Archive Inc.
Authenticity or Damage
In the event that an Item purchased from maudst.ca is confirmed to be inauthentic or damaged upon inspection within 30 days of receipt, the User may be eligible for a refund or exchange, subject solely to the discretion of Maud Archive Inc.
Refunds, Returns, and Exchanges
Maud Archive Inc. retains the sole and absolute discretion to decide whether to issue a refund, accept a return, or facilitate an exchange for any Item purchased through the Website, without any obligation or liability to the User beyond the value of the Item.
Authentication
Maud Archive Inc. exclusively reserves the right to authenticate all Items sold through maudst.ca.
Any determination of inauthenticity shall be made at the sole discretion of Maud Archive Inc., absolving the Company of any liability beyond the refund or exchange value of the Item.
User Obligation
By accessing and utilizing maudst.ca, the User expressly acknowledges and agrees to unconditionally adhere to all Terms outlined herein, including those concerning final sale policy, refunds, returns, exchanges, and authentication.
Modification of Terms
Maud Archive Inc. retains absolute discretion to modify or revise these Terms at any time without prior notice to the User.
The User’s continued use of the Website following any such modifications constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada.
The parties irrevocably submit to the exclusive jurisdiction of the courts of Ontario, Canada.
Severability
In the event that any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between the User and Maud Archive Inc. regarding the use of maudst.ca and the purchase of Items, superseding any prior agreements or understandings, whether oral or written.
Limitation of Liability
The User acknowledges and agrees that Maud Archive Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the purchase or use of Items from maudst.ca, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
